Who can join?
Anyone whose trademark we're filing or have filed, whether it's still pending or already registered. Filed with a different attorney? We can move your mark over to us, as long as there's no open issue on it.
When should I add it?
When you file. Office actions show up during examination, so joining at filing means you're covered when it matters most. You can't join once an issue pops up.
What's a substantive refusal?
It's when the USPTO refuses to register your mark on the legal merits, most often for likelihood of confusion with another mark, or for being “merely descriptive.” We handle simple, non-substantive fixes for every client already.
I have more than one trademark. How does pricing work?
$150/quarter covers your first mark, and each additional mark is $50/quarter. If your billing got messy filing marks at different times, email hi@notavglaw.com and we'll consolidate it.
What if I cancel?
You can opt out, and we'll withdraw as your attorney of record. Any future maintenance filings, monitoring, or refusals would then be on you, or billed at our flat rates.
